1. Publisher and Hosting

This industrial mapping service, hereinafter referred to as the “Platform”, is published and operated by enovating SA.

2. Nature of the Platform and Disclaimer

The Industrial Smart Map is a platform for mapping, exploring, and analyzing industrial and innovation ecosystems. It aggregates, structures, and analyzes information from public sources in order to facilitate the identification of organizations, capabilities, markets, products, and services.

The organization profiles, classifications, and analyses presented are provided for informational purposes only. They result from automated processing and may contain inaccuracies, omissions, or outdated information.

Classifications are based on automated processing and the interpretation of public information. They do not constitute certification, endorsement, or official validation of the activities of the organizations concerned.

Each profile is built using public sources. The official websites and publications of the organizations concerned remain the only authoritative sources.

The publisher disclaims any liability regarding the accuracy, completeness, or timeliness of the information presented. Use of the Platform shall under no circumstances replace direct verification with the organizations concerned or professional advice tailored to specific circumstances.

3. Use of Public Data and Correction Requests

Information relating to listed organizations is collected from publicly available sources, such as websites, publications, registries, press releases, catalogs, databases, and other publicly accessible content.

If an organization believes that information concerning it is inaccurate, incomplete, or outdated, it may request a correction, update, or addition from the publisher.

4. Intellectual Property

The contents of the Platform, including its structure, texts, classifications, interfaces, and layout, are the property of the publisher or are used with the authorization of the respective rights holders.

Information relating to listed organizations is aggregated from public sources. Any unauthorized reproduction, large-scale extraction, redistribution, or reuse is prohibited.

The logos, trademarks, and distinctive signs of referenced organizations remain the property of their respective owners and are displayed for informational purposes only.

5. Cookies

The Platform does not use advertising cookies or tracking technologies for marketing purposes.

Only cookies strictly necessary for the technical operation of the service may be used, including session cookies and language preference cookies. These cookies do not collect personal data for profiling or marketing purposes. In accordance with applicable legislation, such technical cookies do not require prior consent.

B. Privacy Policy

6. Data Controller

The controller responsible for the processing of personal data is enovating SA.

Processing is carried out within the framework of operating, continuously improving, and developing the Industrial Smart Map, a platform dedicated to mapping and analyzing the industrial ecosystem.

7. Data Collected

As part of the use of the Platform, the following data may be collected:

  • IP Address: collected for technical, security, audience measurement, or approximate geolocation purposes.
  • Search Queries: terms entered into the search engine, used to improve the relevance of search results.
  • Interaction Data: clicks, applied filters, and navigation within the Platform, collected in anonymized or aggregated form for statistical purposes.

No directly identifying information, such as name, e-mail address, or telephone number, is collected by the Platform unless voluntarily provided by the user.

8. Legal Basis for Processing

Data processing is based on legitimate interest, pursuant to Article 6(1)(f) GDPR and Article 31 of the Swiss Federal Act on Data Protection (nFADP), pursued by the data controller, namely:

  • The operation and security of the Platform;
  • The continuous improvement of data quality, classifications, and analyses;
  • The optimization of user experience and search result relevance;
  • The development of business intelligence services, sector mapping, and industrial ecosystem analysis.

This legitimate interest has been balanced against the rights and freedoms of data subjects. Given the limited nature of the data collected and its service improvement purpose, the processing does not disproportionately affect users’ rights.

9. Automated Analysis and Artificial Intelligence

The Platform may use automated processing, including artificial intelligence technologies, to structure public information, generate classifications, enrich organization profiles, and produce indicative analyses.

These processes are not intended to personally identify users. Automatically generated results should be considered as exploratory aids and not as definitive or certified conclusions.

Automatically generated classifications, summaries, or recommendations may contain inaccuracies and should be interpreted with appropriate judgment.

10. Data Retention Period

Personal data collected, including IP addresses, is retained for a maximum period of 90 days from the date of collection. After this period, the data is deleted or irreversibly anonymized.

Aggregated and statistical data that does not allow identification may be retained without limitation for analysis, monitoring, and service improvement purposes.

11. Data Sharing

Collected data is neither sold nor transferred to third parties for commercial purposes. It may be shared, strictly within the scope of the purposes described above, with:

  • Technical service providers responsible for hosting, maintenance, and operation of the Platform;
  • Partners or clients involved in the development or operation of industrial mapping projects, only in aggregated or anonymized form whenever possible.

12. Your Rights

In accordance with the GDPR and the Swiss nFADP, you have the following rights regarding your personal data:

  • Right of access to your data;
  • Right to rectification;
  • Right to erasure (“right to be forgotten”);
  • Right to restriction of processing;
  • Right to data portability;
  • Right to object to processing based on legitimate interest.

To exercise these rights, you may submit your request by e-mail to contact@enovating.com.

You also have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or the competent supervisory authority.

13. Security

Appropriate technical and organizational measures are implemented to protect data against unauthorized access, alteration, disclosure, or destruction. Data is transmitted through encrypted HTTPS/TLS connections.

C. Applicable Law and Jurisdiction

14. Applicable Law

These legal notices and privacy policy are governed by Swiss law, including:

  • The Swiss Federal Act on Data Protection (nFADP), SR 235.1;
  • The Data Protection Ordinance (DPO), SR 235.11;
  • The General Data Protection Regulation (GDPR), EU 2016/679, where applicable.

Any dispute relating to the use of the Platform shall be subject to the jurisdiction of the competent courts in Switzerland.

15. Amendments

These legal notices and privacy policy may be updated periodically. Material changes will be indicated by updating the date displayed at the beginning of this document. Continued use of the Platform following such modifications constitutes acceptance of the updated terms.
